Terms of Service

1. Acceptance of Terms

By accessing or using PeakCar ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. The Service

PeakCar provides AI-powered vehicle photo enhancement: background removal, lighting correction, background replacement, and license plate blurring. The Service is provided on a subscription basis with monthly credit allocations, plus optional pay-per-use credits.

3. Eligibility & Account

• You must be at least 18 years old.
• You must provide accurate registration information.
• You are responsible for keeping your password confidential.
• You are responsible for all activity under your account.

4. Subscription, Billing & Refunds

• Subscriptions renew automatically every month in GBP via Stripe.
• Credits reset on each billing cycle and do not roll over.
• You may cancel at any time; cancellation takes effect at the end of the current billing period.
• Refunds: due to the consumable nature of credits and immediate AI processing costs, fees are generally non-refundable. We may issue refunds at our discretion for technical failures attributable to us.
• 1 credit = 1 preset/template background. 2 credits = 1 custom AI-generated background.

5. Acceptable Use

You agree NOT to use the Service to:

• Upload photos you do not own or are not authorized to edit.
• Infringe any third party's copyright, trademark, or privacy rights.
• Generate misleading, deceptive, or fraudulent vehicle listings.
• Process photos of stolen vehicles or vehicles obtained illegally.
• Attempt to reverse-engineer, scrape, or overload the Service.
• Resell access to the Service without our written permission.

6. Intellectual Property

• Your content: you retain all rights to photos you upload and to the AI-enhanced outputs you receive. You grant us a limited license to process them solely to deliver the Service.
• Our platform: the PeakCar name, logo, software, AI prompts, and presets remain our property.
• AI outputs: AI-generated backgrounds may incorporate elements from upstream models. You are responsible for ensuring your final use complies with applicable IP and platform policies.

7. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind. We do not guarantee that AI outputs will be accurate, error-free, or fit for a particular purpose. AI models are probabilistic and may produce unexpected results.

8. Limitation of Liability

To the fullest extent permitted by law, PeakCar's aggregate liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

9. Suspension & Termination

We may suspend or terminate accounts that violate these terms, without refund. You may close your account at any time from your dashboard or by emailing support.

10. Service Changes

We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes that adversely affect paying users.

11. Privacy

Your privacy is governed by our Privacy Policy, which forms part of these Terms.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Turkey. Any dispute will be submitted to the courts and enforcement offices of Istanbul Çağlayan, Turkey. For consumers within the EU/EEA, mandatory local consumer protection rights remain unaffected.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance. We will notify paying users of material changes at least 30 days in advance.

PeakCar, yapay zeka destekli araç fotoğrafı düzenleme hizmeti sunar.

Hesap

18 yaşından büyük olmalı, doğru bilgi vermeli ve şifrenizi gizli tutmalısınız.

Ödeme

Aylık abonelik GBP üzerinden Stripe ile otomatik yenilenir. İptal her zaman mümkündür; mevcut dönem sonunda etkili olur. Krediler bir sonraki döneme devretmez.

Yasak Kullanım

Sahibi olmadığınız fotoğrafları yüklemek, telif/marka ihlali yapmak, yanıltıcı ilanlar üretmek, çalıntı araç fotoğrafı işlemek yasaktır.

Fikri Mülkiyet

Yüklediğiniz fotoğraflar ve AI çıktıları size aittir. Platform markası bize aittir.

Sorumluluk Reddi

Hizmet "olduğu gibi" sunulur. AI çıktılarının doğruluğu garanti edilmez. Toplam sorumluluğumuz talebin önceki 12 ayında ödediğiniz tutarla sınırlıdır.

Uygulanacak Hukuk

Türkiye Cumhuriyeti hukuku uygulanır. İstanbul Çağlayan Mahkemeleri ve İcra Daireleri yetkilidir. Tüketiciler için yerel yasal haklar saklıdır.
